By contracting any service offered by Master Da Web, you automatically agree to the Terms of use described below. Master Da Web reserves the right to change the terms of service at anytime.

1 – Prices

1.1

Master Da Web reserves the right to update the prices offered on the website at any time, as as for new customers and current customers.

1.2

In case of price change for existing customers, they will be notified with at least 30 days of advance.

2 – Affiliate program

2.1

The creation of multiple registrations in order to benefit from the reseller program is not allowed (Affiliate Program) to earn commissions. Master Da Web reserves the right to cancel any registration or commission if evidence of fraud is found.

2.2

To be eligible for withdrawal, the affiliate must have at least 1 active VPS / Cloud service.

3 – Late payments

3.1

Penalty for late payment: A fine of 2% for delay and interest of 0.033% per day will be charged, as permitted by law. (Article 52 da Lei nº 8.078 do CDC).

3.2

Suspension: Web Master services will be suspended after the 4th day of late payment.

3.3

Termination: After 30 days of delay the service will be deleted completely, without the possibility of data recovery.

4 – Service Level Agreement (SLA)

4.1

The average availability of our services is 99.8%. In cases of unavailability in a certain month less than 99%, we provide a credit to the customer's account that can be used to deduct the rent from services. The values ​​are described according to the table below:

To request the credit, it is necessary to open a support ticket, through the customer area http://masterdaweb.io/customer/ within a period of up to 30 days from the date of incident. The calculation of the period of unavailability will be based exclusively on the instruments Master Da Web's internal monitoring.

Rules and exclusions for calculating unavailability:

A. Master Web Services will be considered "Unavailable" when there is no external connectivity.

B. Each item described below is excluded from any downtime calculations:

• Scheduled, recurring or zero-impact maintenance windows;
• Unavailability due to misuse of the service by the contractor;
• Unavailability resulting from the installation, by the contractor, of software and any third-party technology;
• Unavailability arising from using an outdated version of the Master Web Services or third party software, or any failure to install a Material Update for any one of the above;
• Unavailability caused by third-party service providers or facilities, including any service provider or telecommunications facilities, Internet, packet loss, network or Internet issues beyond the Master Da Web edge router that takes connectivity public the internet;
• Denial of service attacks, virus or hacker attacks, or bugs in code, hardware or services for which there is no known commercially reasonable solution (even if there is a known alternative); and force majeure events or any other event not under the direct control of Master Da Web or that could not be avoided even with commercially reasonable;

5 – Content and Usage Policies

5.1

It is prohibited to use Master Da Web services for the purposes listed below:

• Storage/distribution of any copyrighted content without due legal authorization.
• Storage/distribution of malicious and phishing content.
• Storage/distribution of pornographic content.
• P2P, Torrent and Streaming Servers.
• Proxy SQUID / VPN servers used with the purpose of circumventing the internet access of the telecommunication operators.
• Sending SPAM.
• Execution of hacking attacks from any source to third parties.
• Exhaust computing resources of the hired server to the point of harming the infrastructure of the Master Da Web.

5.2

By infringing any Content and Usage Policy, defined in item 5.1, the contracting party will be subject to suspension and/or total cancellation of the service, excluding the contracting party from any right to refund of amounts paid.

6 – Cancellation

6.1

In the act of canceling the service, either for late payments, for requesting cancellation by contracting party or for breach of the Content and Usage Policies (5.1), will result in the total deletion of the data stored in the contracted service, with no possibility of recovering the data stored.

6.2

Upon cancellation of Dedicated Servers (Bare Metal Servers) within the first 30 days from the installation, a SETUP fee of R$ 100.00 will be charged for all manual configuration performed by the technician.

6.3

Cancellations made after 7 days from the date of contracting the service are not eligible for any kind of refund, whether partial or total.

7 – Support

7.1

The Contractor agrees that our Services are "Unmanageable", which means that the configuration and installation of software in the service is the responsibility of the contracting party, as well as the correction of problems caused by service misconfigurations.

7.2

The contractor agrees that Master Da Web does not support third-party Software.

7.3

Master Da Web is solely responsible for providing proper support for Hardware and Network problems of equipment owned by us.
